Booking & Service Policy

By scheduling, booking, or receiving services from Matthew Walker, you acknowledge that you have read understood, and agree to the following terms & conditions: 

Services Provided

Matthew Walker provides professional organizing services designed to help clients create functional and personalized spaces. Organizing services may include decluttering, sorting, categorizing, arranging belongings, and providing recommendations for organizational systems and products. 

Matthew Walker is not a medical, psychological, or mental health provider. Services provided should not be construed as medical treatment, therapy, counseling or professional healthcare advice. Clients are encouraged to consult an appropriate healthcare professional regarding any medical or mental health concerns. 

Pricing & Payment

Matthew Walker charges an hourly rate and offers multi-hour Packages that include discounted hourly rates.

Any hours you do not use from a multi-hour Package that has been prepaid are not eligible for a refund or credit. Some Packages must be scheduled in multiple sessions. The total allotment is valid for 6 months from the date of purchase. After that period, any unused hours will expire. 

Additional time needed outside the original allotment will be billed accordingly. 

Matthew Walker reserves the right to refuse or discontinue services if working conditions are deemed unsafe, unsanitary, or otherwise inappropriate. 

Cancellation & Refund Policy

- Sessions canceled more than forty-eight (48) hours before the scheduled start time are eligible for a full refund of any prepaid service fees. 

- Sessions canceled less than forty-eight (48) hours before the scheduled start time are refundable, minus a cancellation fee of $75. 

- No refunds will be provided once an organizing session has begun or for services already rendered. 

Scheduling & Availability

Appointments and sessions are available on a first-come, first-served basis. Your preferred time and date may not always be available. 

Client Responsibilities 

Clients are responsible for: 

- Being present during appointments unless other arrangements have been made in advance. 

- Providing direction of what items should be kept, donated or discarded within a timely manner to make the best use of time during each scheduled session. 

- Identifying any items that are fragile, valuable, sentimental, hazardous, or require special handling before services begin. 

- Providing a safe and reasonably accessible working environment. 

- Making final decisions regarding items to be kept, donated, discarded, or relocated unless otherwise expressly authorized. 

Matthew Walker will not intentionally discard, donate, or permanently remove a client's belongings without authorization,

Supplies & Organizational Products

Unless otherwise agreed upon in writing, clients are responsible for purchasing any organizational products or supplies recommended during an appointment, including but not limited to storage containers, shelving, labels, bins, and organizers. 

Product recommendations are provided as suggestions only. Clients are solely responsible for determining whether recommended products are appropriate for their home, belongings, and intended use. 

Authorization & Decision-Making

By scheduling a session, the Client represents that they are authorized to be on the property where services will be preformed and have the legal right to direct the handling, sorting, donation, recycling, shredding, or disposal of all items in the work area.

The Client further represents that they have obtained any necessary permissions from co-owners, heirs, executors, or other interested parties (including, but not limited to, family members in estate situations) to make final decisions about what is kept, moved, donated, sold or discarded. Matthew Walker will not dispose of any item without the Client's explicit direction, but relies on the Client's confirmation that such direction is lawful and authorized. If the Client is not the sole decision-maker, the Client is responsible for ensuring that all required consents are in place before the session begins. Matthew Walker is not responsible for mediating disputes between Client and third parties regarding ownership or authority over items, and the Client agrees to hold Matthew Walker harmless from any claims, losses or damages arising from disputes over ownership, authority, or decisions about items. If, at any time, Matthew Walker becomes aware of a dispute or lack of clear authority, he may pause or discontinue services until the Client provides written confirmation that all required consents are in place. 

Liability & Assumption of Risk 

Professional organizing services inherently involve moving, lifting, stacking, storing, and rearranging household items. Clients acknowledge that organizing services may alter the placement and accessibility of their belongings. 

By booking services, clients understand and voluntarily assume the ordinary risks associated with organizing and rearranging household items. 

To the fullest extent permitted by applicable law, Matthew Walker shall not be liable for: 

- The loss, misplacement, or damage of personal property occurring during or following organizing services unless caused by willful misconduct or conduct that cannot legally be waived under applicable law. 

- Injuries sustained by clients, members of the household, guests, or other individuals resulting from the placement, storage, retrieval, or use of organized items following the completion of services. 

- Clients acknowledge that organizational systems are intended to improve functionality and are not guarantees against accidents, breakage, or future disorganization. 

Hold Harmless & Indemnification

To the fullest extent permitted by applicable law, clients agree to release, hold harmless, and indemnify Matthew Walker from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorney's fees, arising from or relating to: 

- The client's use of organized spaces and organizational systems following completion of services. 

- The movement, placement, storage, or retrieval of personal property. 

- Injuries or damages arising from the use or misuse of organized spaces or stored items after services have been completed. 

- Conditions existing within the client's home or property that are outside the reasonable control of Matthew Walker. 

- Information, instructions, or permissions provided by the client regarding their belongings or property. 

Nothing contained herein is intended to waive any rights or remedies that cannot legally be waived under applicable law. 

Dispute Resolution & Arbitration

To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the services provided by Matthew Walker or this Booking & Service Policy shall first be attempted to be resolved informally through good faith discussions between the parties. 

If the dispute cannot be resolved informally, the parties agree to submit the matter to binding arbitration administered by a mutually agreed-upon arbitration provider in San Francisco County, CA. Judgement upon the arbitration award may be entered in any court having jurisdiction. 

This provision shall not prevent either party from seeking relief in small claims court for matters within its jurisdiction or seeking temporary injunctive relief where permitted by law. 

This Agreement shall be governed by and construed in accordance with the laws of the State of California. 

Privacy & Confidentiality

Matthew Walker respects the privacy and confidentiality of all clients. 

Any personal information voluntarily provided in connection with booking or receiving services will be handled in accordance with applicable privacy and security practices. Matthew Walker will make reasonable efforts to maintain the confidentiality of client information and will not disclose personal information except as required by law or as otherwise authorized by the client. 

Clients understand that organizing sessions may involve discussions regarding lifestyle, routines, or neurodivergent conditions. Such discussions are solely for the purpose of providing professional organizing services and do not constitute medical or therapeutic treatment. 

Agreement

By scheduling or receiving services from Matthew Walker, clients acknowledge that they have read, understood, and agree to this Booking & Services Policy in its entirety.
